These terms and conditions are in relation to physical product offerings on the online website store. For Bridal and hair services terms, please refer to the specific Hair Services Terms and Conditions.

Our website offers a range of products and or services for sale. Where we refer to an 'item' we are referring to a single product or service available for purchase on this website.

We will take all reasonable care to ensure that the details displayed for a particular item offered for sale are correct at the time when the information was entered onto the system.

Whilst care is taken to ensure that we display as accurately as possible appearances, colours, textures or finishes, what you will see on your computer monitor or equipment may differ and so we cannot guarantee that images are an accurate representation of the actual goods or services that you are purchasing.

We may not be able to accept your order due to one or more of the following reasons, or for a reason not listed below:

The item you have ordered is out of stock

We cannot authorise your payment or have reasonable grounds to suspect your payment may be fraudulent

There has been a pricing or product description error

There is a system or procurement failure

You have failed our customer validation checks

When you place an order you will receive an email confirming the details of your order. This email is not confirmation that your order has been accepted by us.

Your order will only be accepted by us once your goods have been dispatched.
MODIFICATIONS TO OUR SERVICE AND PRICING

Prices for items are subject to change without notice.

We reserve the right to, at any time, modify or discontinue any part of the service that we offer, or any part of content thereof, without any notice to you.

We accept no liability to you or to any third-party for any modification, price change, suspension or discontinuation of the service.
DELIVERY
ORDER CANCELLATION

If you wish to cancel an order you have placed you must contact us immediately to ascertain whether the items have been dispatched or not. Where they have been dispatched, you will need to return the item to us and you will be responsible for paying the cost of returning the items.

Where items have not been dispatched prior to a cancellation request, our refund policy will apply.

Where you have ordered a personalised, perishable or time critical item (event tickets or e-vouchers) you may not be able to cancel for a full refund.
LIABILITY AND INDEMNITY

We shall not be liable for any direct, special, indirect or consequential or incidental damages including loss of profit or loss of opportunity as a result of the use of or the inability to use any items that have been ordered on this website.

You agree to indemnify us and our agents, officers, directors and employees, immediately and on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of any of our terms and conditions.
JURISDICTION

These terms and conditions shall be governed in accordance with English Law and are subject to the exclusive jurisdiction of the courts of England & Wales.
ENTIRE AGREEMENT

These terms and conditions combined with our published Privacy Policy (also available through this website) and Refund Policy (also available through this website) constitute the entire agreement between the parties and supersede any and all preceding and contemporaneous agreements between you and us whether written or oral.
GENERAL

Should any part-term or term be found to be unenforceable then the remainder of the terms and conditions shall continue to have full force and effect as if the invalidated term was not present.

Should any delay or failure to comply with our obligations under these terms and conditions arise where it is beyond our reasonable control, we will not be responsible to you for such delay or failure nor liable for any loss that you incur, howsoever caused.
TERMS & CONDITIONS OF SERVICE

Please ensure that you have read and understood the terms and conditions below. This information forms part of the agreement for wedding hair and appointments between you and Chatél Noire. You are required to email Charnell at chatel.noire@gmail.com if you do not understand the terms and conditions.

If a deposit is paid, the client should understand that they have automatically entered into an agreement with the T&C’s presented in this document.
The Trial (Bridal Parties Only)
-
Trials give an opportunity for both the bride and Stylist to become acquainted and understand expectations on the day. Recommended time for a trial is 2 – 3 hours depending on the desired look and preparation required. Trials are charged at an hourly rate and a quotation will be provided before this takes place on the occasion that a Bridal Package is not opted for. Trials will be held at the Stylist's house and details will be provided once the deposit has been received.

The trial will be booked at a mutually convenient time and will be arranged between the parties required. If the trail date needs to be changed, both parties agree to give at least 3 weeks prior notice to allow for adequate timing.

As the trial is an opportunity for the Bride and stylist to discuss things one on one, only the Bride should attend the trial, unless they require medical mobility assistance.
The Booking

No agreement for the wedding day Hair style shall be entered into unless all of the following requirements have been satisfied:

A non-refundable deposit has been received in the form of cash or bank transfer. Details on bank payments will be provided when a quote is supplied.

All invoices are subject to change if additional services are required.
-
All deposits are payable within one week or by the agreed payment date at the time of booking.

Application of hair products/ use of tools
-
It is your responsibility to notify Charnell of any health complaint, skin complaint or sensitivity to any part of your face or body or hair that you are aware of at any time that the application of any products is due to commence. It is also your responsibility to ensure that any member of your party requiring hair services by Charnell have notification of the same. Charnell reserves the right to refuse to apply any products to any person whom she suspects of suffering from a health or skin complaint or sensitivity.
Silkpress (Clients with Afro hair)

For silk press, styling services (except bridal) there will be a 50% call out fee which will be used as a deposit prior to the date of the hair appointment.
Hair Accessories/Extensions/Wigs

All prices do not include bridal accessories or hair extensions. These would need to be provided by the client. Recommendations will be made on what hair to buy prior to the event.
Payments
-
An upfront 50% deposit is payable when you book which will confirm the date of your wedding. The remaining balance, in full, is payable within 48 hours of a successful trial or 8 weeks of your wedding/event date, whichever comes first.
Covid 19 – Amendments/Cancellations
-
In the event that your wedding date needs to be postponed due to Government restrictions on large or social gatherings, your booking will be honoured (with a maximum of 3 date changes) up within a 18 month duration. The client will not incur any additional fees unless the location, or job required on the wedding day changes. If this occurs, additional service and travel calculations will then be adjusted and discussed upfront with the client.

In the event that you decide to cancel your wedding in its entirety due to your own personal reasons or in relation to Covid- 19, the general cancellation T&C’s will apply.
Cancellations by the client or client representative
-
You reserve the right to cancel your wedding day hair at any point prior to your wedding day, however please note that your payment is non-refundable unless Charnell has to cancel.
Cancellations by Chatél Noire hair
-
In the unlikely event that Charnell is unable to attend your booking due to sickness, injury, personal emergency or any other circumstance beyond her control, she will endeavour to find a replacement hairstylist of a similar standard. This cannot, however, be guaranteed. If Charnell is unable to find a replacement hairstylist, you will receive a full refund of monies paid, less the trial cost.
Timings

At the trial, Charnell will agree with you a time to arrive and a time to leave on the wedding day. Inevitably proceedings often run late and an allowance will be built into the agreed timings. Should Charnell be required to run over those timings due to lateness on the part of any of the bridal party or any other factor not of Charnell making, then a payment of £10 per half hour will be payable.
Mileage

Mileage is charged at 65p per mile each way and applies to the wedding day**. For weddings outside of London a £50 surcharge will apply on top of the bridal package/service of choice if overnight accommodation cannot be provided.

Early morning call out fees will be charged at £25 before 7.30 am.
**Other Travel/Accommodation
-
If your event cannot be accessed by car, Charnell will seek an alternative means of travel which will be agreed upfront and settled by the client. Accommodation will also be agreed upfront with the client in the event that a start time has to take place before 7am which is outside of the m25.
Assistant Fee
-
If additional assistants are required to cover a larger wedding party booking (over 3 people), the charges will be specific to the individual and quoted upfront.
Photography
-
At the trial Charnell will take pictures of the finished hairstyle. Charnell or the assistant on the day (if required) will also take pictures and videos on the wedding day of the hairstyle of those in the bridal party. These pictures may or may not be used on Charnell’s website www.chatel.noire@gmail.com">www.chatel.noire@gmail.com, which may or may not be used on social Media channels for advertising which Charnell undertakes. By agreeing to these terms and conditions you are confirming that you have no objection to your photos being used in this way. If you object to your pictures being used, please inform Charnell accordingly.
Limitation of liability

Chatél Noire is not an insurer or a guarantor and disclaims all liability in such capacity. If you are seeking a guarantee against cancellation, loss or damage you should obtain appropriate insurance.

All services are conducted on the basis of the information, documents and/or photographs provided by you. Services are for the benefit of you and anyone who you choose to provide services for under this contract.

Charnell is not liable to you or any third party for any actions or omissions outside the remit of the service supplied. Nor is she liable for any problems arising as a result of unclear, erroneous, incomplete, misleading or false information supplied.

Charnell is not liable for any delayed, partial or total non-performance of the services arising directly or indirectly from any event outside her control including your failure to comply with any of your obligations.

Charnell’s liability in respect of any claim for loss, damage or expense of any nature, shall in no circumstances exceed the costs of services she has been contracted to provide.
If any one or more provisions of these Terms and Conditions of Service are found to be illegal or unenforceable in any respect, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired by this.
I have read, understood and am in full agreement with the terms and conditions set out by Chatél Noire hair. It is my full responsibility to make sure that all members of my bridal party abide by the terms and conditions contained in this document.
If you require a print out please let me know; otherwise an email with your conformation of consent is sufficient.
